the departed is indeed a remake of Infernal Affairs (which I like more than the remake) but in terms of legality is legal since scorsese bought the rights to make the remake

"Mou gaan dou" also known as Infernal Affairs is one of the best trilogys I've ever seen. The first one out of the three is the best one. The second tells what happened before that one and the third what happened after the first movie.
You'll find Tony Leung and Andy Lau, 2 of the greatest actors from Asia nowadays.

In fact, "The Departed" is a recollection of these three movies. And supposedly, the actors (Damon and Di Capprio as well as Nicholson reviewed the performance together with the original actors). I haven't seen The Departed yet, and honestly I love the original so much that I'm not sure whether I really want to!! hehehe

Just to make some random comment i want to add that i made some nice discover..
I watched the movie "The Departed" recently, some very awarded movie, and while telling a bit of the story to a friend, she told me she saw an absolutely identical movie, but from asia. : | copyright issue?
Well absolutely not, our Martin Scorsese in fact openly took the same screenplay,
on which "Mou gaan dou" was based a few yrs before, and no surprise it was already awarded greatly.
So this time we have Asia winning on Usa hehe
and now i absolutely must watch the original ..
(to make the comment possibly longer the original movie starred among the others also that Edison Chen who was involved in the scandal of the exposed pics of several actress from movies and series..in HK. Ahem just ponder.. the ppl involved apologized on tv, appeared crying on screen, lost some contracts and received a lot of blame, while instead in the western side of the world if u expose urself or ur intimate life you're quite surely going to become more famous,even if u can do nothing else good.. another good score for asia :D )
